1. Acceptance of these Terms
By ticking the acceptance box and submitting the form, you agree to these Terms. If you do not agree, please do not use the service.
2. Definitions
- Service means the FairPlay web form and related tools for preparing and forwarding submissions to National Treasury.
- Submission means your Budget Tip, any attachments and the personal information you provide.
- Personal Information has the meaning given in POPIA.
3. Our role, no affiliation and no endorsement
FairPlay acts only as a conduit. We transmit your Submission as authored by you, without editing for substance, verification or endorsement. We are not affiliated with, endorsed by, or acting on behalf of National Treasury or any government body. References to third-party services are for convenience only and do not imply endorsement.
4. Views and content responsibility
User content reflects the views of the contributor, not FairPlay. We do not adopt, endorse or verify the content of any Submission. You are solely responsible for your Submission.
5. Eligibility and age
You must be 18 or over to use the Service. If you are under 18, a parent or guardian must submit on your behalf. We may ask for reasonable proof of age or authority.
6. Your promises to us
You warrant that:
a) the Submission is your own content or you have the right to use it,
b) the information you provide is accurate to the best of your knowledge, and
c) the Submission does not contain unlawful, defamatory, abusive, hateful, discriminatory, invasive, infringing, or otherwise harmful material.
7. Licence to use and transmit your Submission
You grant FairPlay a non-exclusive, revocable, royalty-free licence to store, process and transmit your Submission and Personal Information solely to deliver the Service, to provide you with confirmations, and to maintain an audit trail.
8. Consent to forwarding and privacy summary
By submitting, you authorise FairPlay to forward your Submission and the Personal Information you provide to National Treasury for the Budget Tips process.
9. Delivery
We do not guarantee that National Treasury will receive, read or act on any Submission.
10. Right to decline or withhold submission
We may, at our sole discretion, decline to process, transmit or submit any Submission, in whole or in part, at any time and for any reason, including legal, policy, operational or technical reasons. Our decision is final and no correspondence will be entered into. Where reasonably practicable, we may provide the official link so that you can submit directly to National Treasury.
11. Prohibited conduct
You must not use the Service to:
a) breach any law or third-party rights,
b) harass, threaten or defame,
c) distribute malware or spam, attempt to disrupt or overload systems, or bypass security,
d) impersonate any person or misrepresent your affiliation, or
e) submit the same content repeatedly or use automated means to generate Submissions to our Service.
12. Changes, suspension and withdrawal
We may change, suspend or withdraw the Service or these Terms at any time. Material changes will be signposted on the site. Continued use after changes take effect constitutes acceptance.
13. Intellectual property in this site
All site materials are owned by or licensed to FairPlay. Your Submission remains yours, subject to the licence in clause 8.
14. Limitation of liability
To the maximum extent permitted by law, FairPlay will not be liable for any indirect, special or consequential loss, loss of profits, loss of data, loss of goodwill or loss of opportunity.
15. Indemnity
You indemnify and hold harmless FairPlay, its officers, employees and service providers from and against any claims, losses, damages, liabilities, costs and expenses, including reasonable legal fees, arising from your Submission, your breach of these Terms or your misuse of the Service. You agree that you will not bring any claim against FairPlay arising from or connected to our decision to decline, delay or withhold submission, except to the extent such exclusion is not permitted by law.
16. Third-party services
The Service may interact with third-party platforms, for example an official government web form or email system. Those services are governed by their own terms and privacy notices. We are not responsible for third-party acts or omissions.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. The South African courts have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.
18. Severability and whole agreement
If any part of these Terms is held invalid or unenforceable, the remainder will continue in full force. These Terms, together with the Privacy Policy and PAIA Manual, form the entire agreement between you and FairPlay for the Service.
